Child custody (now known as decision-making and parenting time)
Child custody cases can become contentious. Decision-making and parenting
time issues may be complicated. Each family situation is unique. Each
child is unique. Arizona Revised Statute 25-403 applies to provide statutory
factors for the court to consider in making a determination as to what
is in the best interests of the children. There are other factors also
considered by the court. Some cases involve drugs, alcohol, or child abuse,
and we are experienced in handling these cases, too. And if you have a
good working relationship with the other parent, we can help to efficiently
memorialize agreements or help reach a consensus where possible. We can
help you to work toward a solution while attempting to keep your child
custody case out of court if possible.
In divorce cases with minor children, the court will consider an award
of child support. The current Arizona Child Support Guidelines provide
a formula approach to child support which helps to minimize the uncertainty
of each parent's rights and obligations. If you are seeking child
support as a custodial parent or fighting child support requests as a
non-custodial parent, Stein and Stein, P.C. can represent your interests
in court or in pretrial negotiation.
Our team can help with issues regarding enforcement of court orders, modifications
to divorce decrees, and temporary orders during the divorce process. Whenever
you are dealing with these issues, you should have the help of a competent attorney.
Domestic violence / child abuse / neglect
If you have been accused of domestic violence or child abuse / neglect
and are at risk of losing custody of your children, we can help. We also
represent victims of domestic violence and child abuse who need to obtain
Orders of Protection or similar restraining orders against abusive parties.
We also represent parties in juvenile dependencies cases in the juvenile
division of the Maricopa County Superior Court involving the Department
of Child Safety or privately.
At our firm, Co-founding Attorney Maria Stein is a trained mediator in
Mesa, Arizona. She can patiently help you collaborate with your spouse
to work through family law issues in a calm environment and may be able
to help you avoid court. She can also attend private mediation with you
as your attorney to ensure that your rights are protected and can work
to help you receive fair and equitable settlement that you are entitled to.
If you are having difficulty handling property division, our highly trained
attorneys can certainly help. With years of experience, Attorney Maria
Stein can offer assistance with the negotiation or litigation of all property-related
disputes arising out of a divorce. Reaching a fair and equitable division
of community property and affirming one's sole and separate property
may be a complicated process. Valuation issues can be resolved with the
assistance of business valuators, real estate appraisers, and other professionals.
We are experienced in dealing with the experts and these complicated issues.
Depending on the eligibility standards and relevant factors set forth
in A.R.S. 25-319 and applicable case law, one spouse may be able to obtain
an order requiring the other party to pay spousal maintenance. We often
help couples arrange spousal maintenance in a way that is agreeable for
both parties. But if an agreement is not reached or appropriate, we are
prepared to take the matter to trial on your behalf. Spousal maintenance
cases are complicated, and may even involve the expert testimony of a
vocational evaluator to assist the court in making a reasonable determination.
Finding the parenting time schedule that provides for a healthy and happy
relationship between both parents can be a challenge. We assist you in
reviewing parenting time schedules and considerations to find options
that are in your child's best interests and work for all involved.
We can also help maintain enforcement of a schedule or facilitate modifications
in the future.
