Last month, the Supreme Court ruled on a civil rights matter many have
been have been working towards for years: marriage equality. On June 26,
the court declared that our Constitution guarantees the right of marriage
to all Americans—including couples of the same-sex. The landmark
ruling was instantly applauded as a major civil rights victory and celebrated
by LGBT communities throughout the nation.
In the decision, Justice Anthony Kennedy wrote about the importance of
recognizing same-sex marriage rights. "Their hope is not to be condemned
to live in loneliness, excluded from one of civilization's oldest
institutions." Kennedy wrote in the ruling. "They ask for equal
dignity in the eyes of the law. The Constitution grants them that right."
President Obama addressed a White House audience that same day, recognizing
the long road activists have had to endure leading to the ruling. "Progress
on this journey often comes in small increments. Sometimes two steps forward,
one step back," the President said in his address. "And then
sometimes there are days like this, when that slow, steady effort is rewarded
with justice that arrives like a thunderbolt."
What does the decision mean for Arizona?
Arizona passed its own same-sex marriage laws in 2014. However, the Supreme
Court decision now provides already-married same-sex couples with federal
benefits they previously did not have access to.
New federal marriage benefits available to same-sex couples include:
- Numerous Social Security benefits
- Military (and veteran) benefits
- Federal employee benefits
- Various tax considerations
As with any finances shared between spouses, these new benefits could have
an effect on a family law matter, such as a prenuptial agreement or divorce.
If you are in a same-sex couple and would like to approach your current
or anticipated legal issue with counsel that understands the full breadth
of your benefits as a married citizen of the U.S., then we invite you
